25/5/2021: The Department of Enterprise, Trade and Employment issues a draft stating that it is being consulted on in the Office of the Parliamentary Counsel and intends to implement the directive as secondary legislation by 7/6/2021. However as of 19/6/2021 transposition has not occurred.

Timescales of Implementation[edit]

Governmental Documentation[edit]

September 2019: The Department of Business, Enterprise and Innovation sought responses to Articles 13 to 17 with a deadline of 23 October 2019.

October 2019: The Department of Business, Enterprise and Innovation sought responses to Articles 2 to 7 with a deadline of 14 November 2019.

November 2019: The Department of Business, Enterprise and Innovation sought responses to Articles 8 to 12 with a deadline of 4 December 2019.

Summary of Developments[edit]

(e.g. Outline general developments finishing with Day/Month/Year.)

The Department of Business, Enterprise and Innovation has shared a non-paper on Out-of-Commerce works incorporating its preliminary views for discussion after it received approximately 20 submissions from stakeholders. According to the document the Department does not consider it necessary to define "reasonable effort" or provide for specific requirements or procedures around undertaking reasonable efforts. Instead it believes it would be best to require Cultural Heritage Institutions to conduct a search of any appropriate and reasonably-accessible sources of in-commerce works. (1/5/2020)

The Department of Business, Enterprise and Innovation issued an information notice outlining the department's approach to transposition of the Directive. (25/5/2020).

Approach[edit]

Amend existing Copyright and Related Rights Act 2000 by secondary legislation.
