The Department of Business, Enterprise and Innovation has shared a non-paper on Out-of-Commerce works incorporating its preliminary views for discussion after it received approximately 20 submissions from stakeholders. According to the document the Department does not consider it necessary to define "reasonable effort" or provide for specific requirements or procedures around undertaking reasonable efforts. Instead it believes it would be best to require Cultural Heritage Institutions to conduct a search of any appropriate and reasonably-accessible sources of in-commerce works. (1/5/2020)
